Terms and Conditions for Balinese Temple Arts (Paintings) and for Healing Arts (Life Coaching)


1. Scope

The following terms and conditions apply to all online orders of paintings via Balinese-Temple Arts, Sabine Engert, by consumers and entrepreneurs.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in their commercial or independent professional activity.
The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they only become part of the contract if we have expressly consented to this.

2. Contractual partner, conclusion of contract, correction options

The purchase contract is concluded with the artist Sabine Engert.
The presentation of the products in our online shop does not represent a legally binding offer, but merely a non-binding invitation to place an order. By clicking the button “Order now for a fee” in the last step of the ordering process, the customer places a binding order for the goods contained in the order form. The confirmation of the receipt of the order takes place immediately after the order is sent by the customer, but does not yet constitute an acceptance of the contract by us.
When the contract with us is concluded depends on the payment method chosen by the customer:

Payment by bank transfer.

The contract is concluded when your payment is received in the artist’s German bank account.

Payment via Skpye (credit card):

When you place your order, you will receive a link to a Stripe payment button on the Balinese Temple Arts website in the confirmation email. After entering your credit card details and the credit card company, an authorization check will be carried out. After your legitimation as the legal cardholder, the payment transaction will be initiated automatically and your credit card will be charged when the order is placed. The contract with us is concluded at the time the credit card is charged.

3. Contract language, contract text storage

The languages ​​available for the conclusion of the contract: German, English

We save the contract text and send you the order data and our terms and conditions in text form. For security reasons, the text of the contract is no longer accessible on the Internet.

4. Collection, storage and processing of your personal data

In the online shop Balinese Temple Arts, an order is only possible as a guest. We only save your data within the framework of legal obligations. Further information on this can be found in our privacy policy.

We need the following data from you to process your order:
– First and Last Name
– optional company name
– Delivery and invoice address
– E-mail address
– phone number
– Tax identification number for business customers

We use the data provided by the customer without the customer’s separate consent exclusively to carry out the customer order.

The customer is responsible for the correctness of the personal information. Personal details can be updated or corrected at any time before the order is sent using the “Order now for a fee” button.

5. Terms of payment

We only deliver against prepayment.

It is possible to pay by bank transfer stating the order number or using a Stripe payment button, which we provide in the order confirmation via a link to our secure website.

The following payment methods are available in our shop:

When you place your order, you enter your credit card details. After your legitimation as the legal cardholder, the payment transaction is carried out automatically and your card is charged.

6. Delivery conditions and shipping costs

The picture will be delivered within 3-4 weeks. Within Germany and within the United States, the original can be delivered as a canvas, either in a sturdy shipping tube or stretched on canvas, according to customer requirements.
For other countries, only delivery in the mailing tube is possible.
There are no shipping costs within Europe and the USA. If a special type of shipping is required, these costs will be borne by the customer. When delivering to a country other than Germany or the USA, we will state the shipping costs in the confirmation e-mail.
It is possible that customs duties will apply on delivery. The buyer bears customs duties.
We only deliver by mail. Unfortunately, a self collection of the product is not possible.
We do not deliver to packing stations.

7. Cancellation policy for buyers

The customer has the statutory right of cancellation, as described in the cancellation policy .

8. Reservation of title

The goods remain our property until they have been paid for in full.

9. Transport damage

The following applies to consumers: If goods are delivered with obvious transport damage, please complain about such errors to the deliverer as soon as possible and please contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or the transport insurance.

The following applies to entrepreneurs: The risk of accidental loss and accidental deterioration is transferred to you as soon as we have delivered the item to the freight forwarder, the carrier or the person or institution otherwise assigned to carry out the shipment. The duty of inspection and notification of defects regulated in Section 377 of the German Commercial Code (HGB) applies to merchants. If you omit the notification regulated there, the goods are considered approved, unless there is a defect that was not recognizable during the examination. This does not apply if we have fraudulently concealed a defect.

10. Warranties and guarantees

Unless expressly agreed otherwise below, the statutory right to liability for defects applies.
For entrepreneurs, the limitation period for claims for defects in newly manufactured items is one year from the transfer of risk.
With regard to entrepreneurs, only our own information applies as an agreement on the quality of the goods.
In the Balinese Temple Arts online shop you can find photographic representations of my original paintings. These are all unique, the exact shape and color of which also depend on the conditions when the photo was taken. I try to reproduce the colors in the photos as realistically as possible.
However, since the color nuances shown also depend on the settings of your screen, I cannot guarantee the color accuracy. Slight deviations in the images from the original color are therefore due to technical reasons and are not considered a defect.

The above restrictions and shortened deadlines do not apply to claims based on damage caused by us, our legal representatives or vicarious agents
• in the event of injury to life, limb or health
• in the event of willful or grossly negligent breach of duty as well as malice
• In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and compliance with which the contractual partner can regularly rely (cardinal obligations)
• as part of a guarantee promise, if agreed
• as far as the scope of the product liability law is opened.

11. Liability

We are always unrestrictedly liable for claims due to damage caused by us, our legal representatives or vicarious agents
• in the event of injury to life, limb or health
• in the event of willful or grossly negligent breach of duty
• for guarantee promises, if agreed, or
• as far as the scope of the product liability law is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely, (cardinal obligations) through slight negligence on the part of us, our legal representatives or vicarious agents, the amount of liability is foreseeable at the time the contract was concluded Limited damage, the occurrence of which is typically to be expected.
Otherwise, claims for damages are excluded.

12. Dispute resolution

13. Final provisions

If you are an entrepreneur, German law applies to the exclusion of the UN sales law.

3. Subject matter of the contract

  • Healing Arts Coaching offers the user kinesiological online coaching, online counseling and online training. It is possible to check the availability of appointments and to book appointments online.
  • The user has the option of using the booking system for coaching / advice / training via an encrypted video call.
  • By clicking on the calendar, users can book the desired date and type of coaching, advice or training, and the user is then forwarded to the payment option. The user receives a confirmation email about the booked appointment.

Healing Arts Coaching reserves the right to change these terms and conditions at any time with effect for the future.

Important note on online coaching / advice and training
Online coaching or online counseling can be helpful, but cannot replace a doctor’s visit or on-site psychotherapy.
For example, in acute pain, acute psychosis, schizophrenia, severe depression, borderline personality disorder (BPD), severe addictions or thoughts of suicide, Healing Arts Coaching is not suitable. In these cases you should contact the emergency services or rescue services. If you have an emergency, please call an auxiliary number or the local emergency services.

The client is responsible for using our service.

4. Coaching / consulting / training services and conclusion of contract

Scope of coaching / advisory / training services
The scope of the service is based on the respective coaching package, advisory service or the training tender. A guarantee for a subjectively presented coaching / consulting or training course on the part of the client is not given. Coaching sessions that are not used within the validity period stated online and stated in the booking confirmation / invoice will expire without replacement.
Healing Arts Coaching points out to the client that the alternative practitioner and kinesiologist Sabine Engert is not allowed to offer any medicine / therapy. Coaching and advice via the online platform cannot replace personal treatment by a doctor, psychologist, psychotherapist and, if necessary, a physical / psychological examination, diagnosis and / or therapy.

Participation in online coaching, online counseling or training requires normal mental and physical resilience.

The client has the opportunity to choose the coaching / consulting or training offer that suits them. The details of the scope of services can be found in the coaching / consulting or training offer. By confirming the “Book with obligation to pay” button, the client submits a binding booking. After submitting the form, the client receives a confirmation of receipt of his booking. The contract is concluded by paying for the booked service.

5. Registration / booking

  1. The use of Healing Arts Coaching does not require a user (user-specific account) and no registration. When booking coaching / consulting or training, it is assumed that the client truthfully and completely transmits all of the data requested in the registration mask to Healing Arts Coaching. When booking, the client must be at least 18 years old and have unlimited legal capacity.
  2. After booking, the client receives an e-mail with a confirmation link as a booking confirmation and, if requested, the user agreement in accordance with the general terms and conditions to an e-mail address specified by him during the booking.
  3. There is no legal entitlement to use the services of Healing Arts Coaching. Healing Arts Coaching is entitled to refuse the coaching for personal or other reasons, if a professional basis of trust cannot be built.

6. Cancellation instruction for consumers in distance contracts (services)

The client has the statutory right of withdrawal, as described in the cancellation policy.

7. Information requirements

  • All further information about Healing Arts Coaching, the offer and the processing can be found in the texts on Arts.
  • Regarding the technical steps for the conclusion of the contract, the paragraph on the subject matter of the GTC must be observed
  • The client can call up, copy, save and print out the contract text at any time using the booking confirmation link sent by. Healing Arts Coaching itself saves the contract texts and sends them to the client by email at the request of the client. The client can cancel and correct his entries at any time during the booking.
  • The language available for the conclusion of the contract is German and English.
  • There is no out-of-court complaint or redress procedure to which Healing Arts Coaching is subject.
  • The European Commission provides a platform for online dispute resolution (OS), which you can find here []. We are ready to take part in an out-of-court arbitration procedure before a consumer arbitration board.

8. Usage rights

The client is exclusively entitled to the rights granted to the Internet offer according to these general terms and conditions.

The content, information, images or videos published on the Healing Arts Coaching website are generally protected by copyright and are usually owned or licensed by Healing Arts Coaching.
The content on the website may only be used or reproduced for personal and not for commercial purposes. Passing on the content is prohibited without the express consent of Healing Arts Coaching, Sabine Engert.

9. Client data

1. Healing Arts Coaching, Sabine Engert, collects and uses the data provided by the client to process the contracts concluded between the client and Healing Arts Coaching and to provide the services. No data is collected, processed, passed on or used without the consent of the client. The data collected with consent will only be processed or used insofar as this is necessary for the processing of the contractual relationship and for the performance of services.
2. The client has the possibility at any time and within the scope of the availability of the online coaching / consulting or training offer to call up, change or delete the data stored by him from the booking link sent to him.

4. Healing Arts Coaching is subject to professional confidentiality towards third parties. In exceptional cases, in which, according to the assessment of the alternative practitioner Sabine Engert, a risk for the client or third party must be assumed (suicide or killing, abuse of children, etc.), there is a legal obligation to provide information.

10. Liability

Liability or guarantee for the occurrence, compliance or punctuality of the consultation appointments booked online is excluded.
Healing Arts Coaching, Sabine Engert, is only liable for damages, in particular due to delay, non-performance, poor performance or unlawful action, if essential contractual obligations are breached, and the fulfillment of which could be relied on to a particular extent. Otherwise, Healing Arts Coaching accepts no liability unless there are compelling statutory regulations. The exclusion of liability does not apply to willful intent and gross negligence.
Healing Arts Coaching is only liable for foreseeable damage. Liability for indirect damage, in particular consequential damage, unforeseeable damage or atypical damage as well as lost profit, is excluded. The same applies to the consequences of labor disputes, accidental damage and force majeure.
The above limitations of liability apply to all contractual and non-contractual claims.

11. Availability

The Arts range of services is usually available 24 hours a day. This does not apply to the times in which backup work is carried out and system maintenance or program maintenance work is carried out on the system or the database.
Healing Arts Coaching strives to keep the possible disruptions as low as possible.
Healing Arts Coaching excludes any liability for technical or other malfunctions.

12. Prices and other price components

The prices published on the Arts website at the time the contract is concluded apply.
All prices quoted are in euros (EUR).
In the case of online coaching / consulting or training, the usual costs for the user’s internet connection are incurred in addition to the prices shown for the respective consulting offer.
Healing Arts Coaching does not use any premium services, information services, mass traffic services, service services, new services or speed dialing services within the meaning of § 66a TKG.

12. Payment processing

1. Credit card
Every transfer when paying by credit card is free of charge and processed via a secure and encrypted SSL connection.
We accept payments with the following credit cards: MasterCard Credit, MasterCard Debit, Visa Credit, Visa Debit and Visa Electron.

In particular, when using SPAM filters, the client must ensure that all emails sent by Healing Arts Coaching or by third parties commissioned with the booking processing can be delivered.
3. Cancellation
A booked consultation appointment can be canceled free of charge by email up to 24 hours before the agreed appointment, whereby the cancellation letter must be received by Healing Arts Coaching no later than 24 hours before the agreed appointment. In the event of a later cancellation, the agreed amount is due in full. The client reserves the right to prove that no or lower costs were incurred for Healing Arts Coaching.

13. Final provisions

1. German law applies.
2. Should individual provisions of these general terms and conditions, including this provision, be or become wholly or partially ineffective, the validity of the remaining provisions remains unaffected. Instead of the ineffective or missing provisions, the respective legal regulations come into force.
